Edith Windsor : American Hero

Edith Windsor and Thea Spyer, a same-sex couple residing in New York, were lawfully married in Toronto, Ontario - Canada, in 2007.

Spyer died in 2009, leaving her entire estate to Windsor. Because their marriage was recognized by the state of New York, Windsor sought to claim the federal estate tax exemption for surviving spouses.

She was barred from doing so by Section 3 of DOMA, which provided that the term "spouse" only applies to a marriage between a man and woman. In effect, the Internal Revenue Service found that the exemption did not apply to same-sex marriages, denied Windsor's claim, and compelled her to pay $363,053 in estate taxes.

On November 9, 2010, a lawsuit was filed against the federal government in the United States District Court for the Southern District of New York, where Windsor sought a refund because DOMA singled out legally married same-sex couples for "differential treatment compared to other similarly situated couples without justification".

On June 26, 2013, the Court issued a 5–4 decision which found Section 3 of DOMA to be unconstitutional "as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment"

House Dems Tweet Jubilation, GOP Silent After DOMA Struck Down

Democrats in the House of Representatives reacted with jubilation to the Supreme Court’s decision to strike down the Defense of Marriage Act, but the reaction from Republicans was almost entirely muted.
 
Scores of Democrats tweeted their excitement and agreement with the Court when the decision was announced.
 
@NancyPelosi: Today, the Supreme Court bent the arc of history once again toward justice, discarding the defenseless #DOMA into the dustbin of history.
 
House Speaker John Boehner held a previously scheduled news conference at the Capitol, but when he was asked to react to the Courts decision, he punted.
 
“I heard the decision. I’ve not had a chance to read it. Once we’ve had a chance to read it, I’ll have a response for you,” Boehner, R-Ohio, said. “After I’ve read the decision, we’ll have something for you.”(keep reading)

Gay Marriage Ruling: Supreme Court Finds DOMA Unconstitutional



In a pair of major victories for the gay rights movement, the Supreme Court on Wednesday ruled that married same-sex couples were entitled to federal benefits and, by declining to decide a case from California, effectively allowed same-sex marriages there.
      
The rulings leave in place laws banning same-sex marriage around the nation, and the court declined to say whether there was a constitutional right to same-sex marriage. But in clearing the way for same-sex marriage in California, the nation’s most populous state, the court effectively increased to 13 the number of states that allow such unions.
      
The decision on federal benefits will immediately extend many benefits to couples in the states where same-sex marriage is legal, and it will give the Obama administration the ability to broaden other benefits through executive actions.
      
The case concerning California’s ban on same-sex marriage, Proposition 8, was decided on technical grounds, with the majority saying that it was not properly before the court. Because officials in California had declined to appeal a trial court’s decision against them and because the proponents of Proposition 8 were not entitled to step into the state’s shoes to appeal the decision, the court said, it was powerless to issue a decision. That left in place a trial court victory for two same-sex couples who had sought to marry.

Justin Bieber Going To Rehab?

Justin Bieber’s handlers fear the pop star is spiralling out of control.

RadarOnline.com reports that Scooter Braun, the 19-year-old Canadian heartthrob’s manager, is mulling sent Bieber to rehab for a short, sharp visit. The gossip website says Braun is concerned by the Baby singer’s accelerated use of alcohol and marijuana.

A source told Radar: “Justin is hanging out with the wrong people. It’s been one incident after another with him ... Scooter wants him to go to rehab to get his act together.”

Bieber’s past three months have featured one faux pas after another, not least showing up late for his own concerts. In Holland, he suggested Holocaust heroine Anne Frank would have been a Belieber and was widely mocked for it. (source)

It was the first time Nadal, the great Spanish champion, had lost in the first round in singles at a Grand Slam event, and his unlikely tormentor on Court 1 on Monday was Steve Darcis, a Belgian veteran ranked just 135th who spent part of this season competing in the minor leagues of professional tennis, the challenger circuit.

In the end, Darcis’s 7-6 (4), 7-6 (8), 6-4 victory seemed surprisingly straightforward, almost shockingly so, for what was one of the biggest upsets in Wimbledon history.(nyt)
